What is Board Certified in Bankruptcy Law & What are the Requirements?

Board Certified Bankruptcy Lawyers

Board certified Elizabeth bankruptcy  lawyers represent private parties who typically are contemplating filing bankruptcy.

Though many states have certification programs or specialization programs in various areas of law, New Jersey has elected not to offer specialization programs to its members. However, New Jersey, like other jurisdictions that do not have specialization programs, does recognize that there are organizations that do offer programs that offer a specialization recognition. If a lawyer licensed in New Jersey wishes to apply for such a specialization and obtains it, that is permissible. However, if that lawyer wishes to advertise or place that specialization where the public can be exposed to it, that lawyer must adhere to the requirements of:

Rule 7.4. These requirements are as follows:

(a) A lawyer may communicate the fact that the lawyer does or does not practice in particular fields of law. A lawyer may not, however, state or imply that the lawyer has been recognized or certified as a specialist in a particular field of law except as provided in paragraphs (b), (c), and (d) of this Rule.
 
(b) A lawyer admitted to engage in patent practice before the United States Patent and Trademark Office may use the designation "Patent Attorney" or a substantially similar designation.
 
(c) A lawyer engaged in admiralty practice may use the designation "Admiralty," "Proctor in Admiralty," or a substantially similar designation.
 
(d) A lawyer may communicate that the lawyer has been certified as a specialist or certified in a field of practice only when the communication is not false or misleading, states the name of the certifying organization, and states that the certification has been granted by the Supreme Court of New Jersey or by an organization that has been approved by the American Bar Association. If the certification has been granted by an organization that has not been approved, or has been denied approval, by the Supreme Court of New Jersey or the American Bar Association, the absence or denial of such approval shall be clearly identified in each such communication by the lawyer.
 
Very recently, New Jersey started offering lawyer certifications in:
  1. Civil Trial Attorney Certification;
  2. Criminal Trial Attorney Certification;
  3. Matrimonial Law Attorney Certification; and
  4. Workers’ Compensation Law Attorney
The New Jersey Supreme Court Board on Attorney Certification administers the certification program in New Jersey. The Board consists of nine members, all of whom are members of the Bar of New Jersey. In addition, there are four Certification Committees that are responsible for reviewing certification applications and for creating and grading the certification examinations. These Committees are: the Civil Trial Law Certification Committee; the Criminal Trial Law Certification Committee; the Matrimonial Law Certification Committee; and the Workers' Compensation Law Certification Committee. Each Committee reports its eligibility findings to the Board for its report to the Supreme Court.
 
However, New Jersey does not offer a certification in Bankruptcy. It does accept the following entity as an ABA approved certification:

They offer a certification in Business Bankruptcy and Consumer Bankruptcy.

If you wish to retain an attorney it is not essential that they be a "Specialist" in Bankruptcy to do an excellent job However, if you wish to only choose a lawyer that has earned a "Specialization" from an ABA approved organization and you are unsure if they have a specialization, simply ask if they do hold such a specialization.
